The jury considering the fate of a former Lompoc prison guard charged with murder was unable to come to a verdict and the judge declared a mistrial on Friday.
Timothy McNally was charged with fatally shooting another prison guard at a Lompoc hotel in 2012.
McNally said it was an accident. The prosecution says evidence shows it was murder.
Earlier on Friday, the jury told the judge it could not decide on a verdict. The judge sent the jury back to the jury room to resume deliberations.
The jury ended up deadlocked 7-5 and was dismissed by the judge.
